The Terms & Conditions and the use of this Website are provided by NuCape Beach Property (Pty) Ltd. By using this Website and clicking the “I AGREE” or “ACCEPT” button herein, the user shall be deemed to have agreed to all the Terms and Conditions as provided on this Website.
2. DELIVERY POLICY
Subject to availability and receipt of payment, requests will be processed within 14 days and delivery confirmed by way Booking Reservation Number. (e.g. booking number / booking voucher via email)
3. GENERAL TERMS & CONDITIONS FOR RESERVATIONS
You warrant that by making this booking, you are over the age of 18 and that all information given by you to NuCape Beach Property (Pty) Ltd is accurate, true and correct. Whilst every effort is made to update the information provided on this Website, NuCape Beach Property (Pty) Ltd accepts no liability for the accuracy and/or completeness of the information provided. NuCape Beach Property (Pty) Ltd accepts no liability for any loss or damage to your computer or interception, or use, of your credit card information, are howsoever caused. These Terms & Conditions constitute the entire agreement between the parties.
4. DEPOSITS, PRE-PAYMENTS & CANCELLATION POLICY
Guests will not be checked in until the reservation has been paid for in full. No verbal cancellations of reservations will be accepted. All cancellations must reach us by email. The following cancellation charges shall apply:
100% Refund if a reservation is cancelled 30 or more days prior to arrival;
50% Refund if a reservation is cancelled 15 or more days prior to arrival;
25% Refund if a reservation is cancelled 7 or more days prior to arrival;
No Refund will be given for a reservation cancelled 6 or fewer days prior to arrival.
Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the NuCape Beach Property (Pty) Ltd bank account, the details of which will be provided on request. Card transactions will be acquired for NuCape Beach Property (Pty) Ltd via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy. Customer details will be stored by NuCape Beach Property (Pty) Ltd separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR). NuCape Beach Property (Pty) Ltd takes responsibility for all aspects relating to the transaction including the sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
5. CUSTOMER PRIVACY
NuCape Beach Property (Pty) Ltd shall take all reasonable steps to protect the personal information of users. 6. LIMITATION OF LIABILITY
NuCape Beach Property (Pty) Ltd, its owners, shareholders, agents, contractors or employees shall not be liable for any loss, damage, destruction, injury or death which may be caused to any person or the assets, property or any other item of equipment or the likes thereof which may occur as a result of any foreseen or unforeseen event or any act or omission on the part of the NuCape Beach Property (Pty) Ltd, its owners, shareholders, agents, contractors or employees.
7. COUNTRY OF DOMICILE & JURISDICTION
NuCape Beach Property (Pty) Ltd chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, No.1 Sohland Avenue, Constantia, Cape Town, South Africa. This website and these Terms and Conditions shall be governed by South African law and the guest submits to the jurisdiction of the South African courts in respect of any issue that may arise.
8. VARIATION
NuCape Beach Property (Pty) Ltd may, in its sole discretion, amend these Terms and Conditions or any part thereof at any time without notice.
